Mr. Levensten actively participated in the Delaware River oil spill class action litigation (E.D. of PA) representing property owners seeking testing and remediation of their contaminated properties.Mr. Levensten served as both lead trial counsel in a wrongful death case and associate counsel in two additional federal cases brought against national and multinational corporations who manufacture and distribute products containing benzene. The suits were brought by an estate of a decedent, and two men who contracted acute myelogenous leukemia caused by exposure to the defendants lethal products. In 2005, all three cases achieved large confidential settlements. Only a small circle of attorneys shares Mr. Levensten’s success in Benzene litigation.
ANTITRUST LITIGATION:
Mr. Levensten actively participated in the Microsoft Antitrust Multidistrict Litigation on behalf of direct purchasers of certain Windows® software. A multimillion-dollar settlement was reached in that antitrust litigation. The case was pending on the docket of U.S. District Court in Maryland before U.S. District Judge J. Frederick Motz.Mr. Levensten actively participated in the Sumitomo Copper Antitrust Litigation which achieved a multimillion dollar recovery on price manipulation claims under the Commodity Exchange Act, 7 U.S.C. Section 1 et seq. See e.g., In re Sumitomo Copper Litigation, 74 F. Supp. 2d 393, 395 (S.D.N.Y. 1999) (”The recovery is the largest class action recovery in the 75 plus year history of the Commodity Exchange Act”);
